1. Introduction
These Terms and Conditions apply to the use of the website of Fullscape and to all services provided by Fullscape.
By accessing this website, submitting an enquiry, booking a call, or purchasing a subscription or service from Fullscape, you agree to these Terms and Conditions.
2. About Fullscape
Fullscape is a design business established in the Netherlands and operating as a VOF.
Fullscape provides graphic design subscriptions and related design services for businesses in Europe, the United Kingdom, the United States, and Canada.
3. Business Customers Only
Fullscape provides services to businesses only. The website, services, subscriptions, proposals, and agreements are intended for business use and not for private consumer purchases.
If a person purchases services on behalf of a company or organisation, that person confirms that they have authority to bind that business to these Terms.
4. Services
Fullscape offers graphic design services, including subscription-based design support and custom design work.
The exact scope, deliverables, turnaround times, communication process, and any limitations of the services may be described on the website, in a proposal, in onboarding materials, or in a separate written agreement.
Unless expressly agreed otherwise in writing, Fullscape does not guarantee:
- a specific business result;
- uninterrupted availability;
- immediate delivery of all requests;
- acceptance of unlimited work outside the agreed scope.
5. Subscription Services
Where services are provided on a subscription basis, the subscription is billed monthly unless otherwise agreed in writing.
Subscriptions continue until cancelled by either party in accordance with these Terms or any separate written agreement.
A subscription gives the client access to design services within the agreed scope and workflow. It does not transfer ownership of Fullscape’s working methods, internal systems, unused concepts, or any tools used to provide the service.
6. Onboarding and Access
Fullscape may provide services through digital tools, shared workspaces, client portals, email, and other online platforms.
The client is responsible for providing accurate information, timely feedback, necessary source materials, and access to any required systems or assets.
Delays caused by missing information, slow approvals, or lack of cooperation from the client may affect delivery times.
7. Pricing and VAT
All prices displayed or quoted by Fullscape are in EUR and are exclusive of VAT, unless explicitly stated otherwise.
Any applicable VAT, taxes, bank charges, or transfer fees will be added where required by law or invoicing practice.
Fullscape reserves the right to update pricing at any time for future subscriptions, renewals, or new work. Existing clients will be informed in advance where applicable.
8. Payment Terms
Payments may be made by Stripe or bank transfer.
Invoices must be paid within the period stated on the invoice or checkout page. If no period is stated, payment is due immediately.
If payment is late, Fullscape may:
- suspend ongoing work;
- pause access to services;
- withhold delivery of final files;
- charge any lawful interest or recovery costs where applicable.
9. Refund Policy
Fullscape offers a 14-day refund period from the start date of a new subscription or service engagement, unless otherwise agreed in writing.
This refund policy applies as a contractual policy offered by Fullscape and is not intended as a statement of statutory consumer rights.
No refund will be owed where:
- the agreed work has already been substantially performed;
- the client has materially used, approved, or benefited from delivered work;
- the request concerns work outside the refund period;
- the refund request is abusive or made in bad faith.
Any approved refund will be limited to the amount paid for the relevant service period and excludes third-party costs and already-approved custom work.
10. Cancellation
Monthly subscriptions may be cancelled on a monthly basis.
Unless otherwise agreed in writing, cancellation will take effect at the end of the current billing period. Fees already paid for the current billing period are generally non-refundable, except where Fullscape expressly agrees otherwise or where the refund policy in Clause 9 applies.
Cancellation must be submitted in writing by email to jordan@fullscape.com.
11. Scope Changes and Additional Work
Any work requested outside the agreed subscription scope or project scope may be treated as additional work and may be quoted separately.
Fullscape reserves the right to decide whether a request falls within the existing scope or requires a separate agreement.
12. Intellectual Property
All content on the Fullscape website, including text, branding, graphics, layout, visuals, documents, and materials, remains the property of Fullscape or its licensors unless stated otherwise.
For client work, intellectual property rights in final approved deliverables will transfer only to the extent and at the time expressly agreed in writing, and only after all relevant invoices have been paid in full.
Fullscape retains ownership of:
- preliminary concepts;
- drafts and unused variations;
- internal processes and systems;
- templates, frameworks, and methodologies;
- portfolio presentation materials, unless otherwise agreed.
13. Portfolio Rights
Unless otherwise agreed in writing, Fullscape may display completed work, the client’s name, and related visuals in its portfolio, website, social media, pitches, and marketing materials for the purpose of showcasing its work.
If confidentiality applies, the client must notify Fullscape in writing before the project starts or before any public release.
14. Client Responsibilities
The client agrees to:
- provide accurate and complete information;
- ensure they have rights to all materials they supply;
- review work and provide feedback within a reasonable time;
- ensure any factual, legal, or regulatory claims in their content are properly checked before use.
Fullscape is not responsible for errors caused by inaccurate client-provided information or by approvals given by the client.
15. Third-Party Services
Fullscape may use third-party platforms and tools in the course of providing services, including payment providers, hosting services, scheduling tools, and collaboration platforms.
Fullscape is not responsible for failures, outages, delays, or security issues caused by third-party providers beyond its reasonable control.
16. Limitation of Liability
To the maximum extent permitted by law, Fullscape will not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, loss of business, loss of data, or reputational harm.
Fullscape’s total liability in connection with any claim arising from the services or website will be limited to the amount paid by the client to Fullscape for the specific service period or project giving rise to the claim.
Nothing in these Terms excludes liability where liability cannot lawfully be excluded or limited under applicable law.
17. Website Use
You may not use the website:
- for unlawful purposes;
- to interfere with its operation or security;
- to attempt unauthorised access to systems or data;
- to upload harmful, misleading, or malicious material.
Fullscape may suspend or restrict website access where reasonably necessary for maintenance, security, or legal reasons.
18. Privacy
Use of the website is also governed by the Fullscape Privacy Policy and Cookie Policy.
19. Confidentiality
Both Fullscape and the client shall treat confidential business information exchanged during the relationship as confidential and shall not disclose it to third parties except where required by law or necessary for service delivery.
20. Force Majeure
Fullscape will not be liable for delay or failure to perform caused by circumstances beyond its reasonable control, including internet failure, cyber incidents, illness, strikes, natural events, supplier failure, or government action.
21. Changes to These Terms
Fullscape may update these Terms and Conditions from time to time. The latest version will always be published on the website with the effective date.
22. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Netherlands.
Any dispute arising out of or in connection with these Terms or the services provided by Fullscape shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
